All perfect praise be to Allah, The Lord of the Worlds. I testify that there is none worthy of worship except Allah, and that Muhammad, sallallaahu ‘alayhi wa sallam, is His slave and Messenger.
This woman should pay Zakaah on her gold every year, even if the amount of gold remains the same without increase. The reason that Zakaah becomes liable is that the gold reaches the Nisaab (the minimum amount liable for Zakaah). Shaykh Ibn ‘Uthaymeen, may Allaah have mercy upon him, said in Majmoo‘ Al-Fataawa: “The Nisaab of gold is eighty-five grams. What is less than that is not liable for Zakaah, and whatever reaches eighty-five grams becomes liable for Zakaah. How to pay the Zakaah? We estimate its monetary value and pay a quarter of the tenth of that value (2.5 %). The way to do that is to divide the estimated value by forty, and the result is the amount of the due Zakaah. So if the value of the jewelry equals forty thousand Riyals, the Zakaah is one thousand Riyals, and if its value equals four hundred thousand Riyals, the Zakaah is ten thousand Riyals, and this is how you calculate the Zakaah.” [End of quote]
It is noteworthy that the jurists held different opinions regarding the Zakaah on jewelry kept for a woman’s personal use, whether or not it is liable for Zakaah. The majority of scholars held that it is not liable for Zakaah, while others held that it is liable for Zakaah as long as it reached the Nisaab and a lunar year elapsed while it is in her possession. The opinion of the majority of scholars is the preponderant one. However, it is more prudent to pay Zakaah on it in order to be on the safe side and to avoid an area in which there is a scholarly difference of opinion.
